法律的生命在于法律的实现,法律的最终实现方式是执行,执行是维护社会公正的最后一道防线,执行救助成为捍卫社会公正的最后一块遮羞布。随着司法改革的推进,执行救助逐渐受到世人的关注。在执行过程中,当个人的生存权难以实现的时候,国家有义务保证公民最起码的生存权。这种义务不是国家对公民的施舍,而是国家对公民应尽的义务。在中国社会转型的大背景下,执行救助影响着法院的形象,甚至关乎着社会的稳定与发展,折射出具有中国特色的的问题。
