森林碳汇原属于森林的自然属性,它却走入立法者的视野,通过设定权利和义务关系成为法律制度而具有了社会属性。究其原因,是因为气候变化导致人类的生存环境受到威胁。作为独立的客观存在,森林碳汇因具有稀缺性、价值性并具有民法上“物”的特征,为构建法律制度奠定了基础。构建该制度,需要借鉴国外的成熟经验,具体包括将其纳入森林法体系中去、分阶段实施森林碳汇制度、构建森林碳汇有效运行机制等内容。
Forest carbon sink originally belonged to the natural attributes of the forest, but it entered the field of vision of lawmakers and possessed social attributes by setting rights and obligations as a legal system. The reason is because climate change causes human being’s living environment to be threatened. As an independent and objective existence, due to its scarcity and value nature and its characteristic of civil law, forest carbon sink lays the foundation for the construction of legal system. To build the system, we need to learn from the mature experience of foreign countries, including including it in the forest law system, implementing the forest carbon sink system in stages, and building an effective operation mechanism of forest carbon sinks.
