政府责任与公务人员责任的对接是一个从人到人的过程。公民与公务人员之间的关系是一种双重代理关系,全体公民通过契约组成政府,命其代理国家事务,而公务人员作为政府的一部分,同样具有政府代理人的角色。这种双重代理关系决定了政府责任与公务员责任是两个不同层面的问题却又须臾不可分离。政府责任与公务人员责任通过作为现代政府责任实现工具的官僚制组织模式统一起来,在法治原则的基础上形成一个闭合的责任链条,而正当行政程序应当成为这一链条的纽结。 The connection between government responsibility and public officials’ responsibility is a process from human to person. The relationship between citizens and civil servants is a dual agency relationship. All citizens make up the government through contracts and act as their agents for state affairs. As a part of the government, civil servants also have the role of government agents. This dual agency relationship determines that government responsibility and civil service responsibility are two different levels of problems that must be inseparable. Government responsibility and public servant responsibility are unified through the bureaucratic organizational model that is the tool for the realization of modern government responsibility, forming a closed chain of responsibility based on the principle of the rule of law, and due process of administrative procedures should be the kink in this chain.
